ESRB Privacy Online’s Program Requirements apply to the online collection, use and disclosure of personal information. Our Requirements clearly explain how to promote practices that foster consumer confidence online.
Depending on the target audience and other relevant factors, member websites may be subject to one of two Seal Requirements.
ESRB Privacy Online Seal Requirements apply to websites directed to users 13 and over. If any part of a company's website is directed to children under 13 (12 years and younger) or a company has actual knowledge that it is collecting personal information from children under 13, it must follow our Kids Privacy Online Seal Requirements.
ESRB Kids Privacy Online Seal Requirements apply if any part of a company's website is directed to children under 13 (12 years and younger) or if a company has actual knowledge that it collects personal information from children under 13. Federal law requires such a website to comply with the requirements of the Children’s Online Privacy Protection Rule (16 C.F.R. Part 312). ESRB’s Kids Privacy Online Seal Requirements may be modified as necessary to meet the requirements of the Children’s Online Privacy Protection Act (“COPPA”). ESRB Kids Privacy Online Seal Requirements have been approved by the Federal Trade Commission as an authorized COPPA “Safe Harbor.”
